*** DAYA CHAUDHARY, J. (Oral) The present petition is of the year 2011 and has been filed under Section 482 Cr.P.C. for modification of orders dated 01.10.2010 and 31.05.2010 passed by learned Sessions Judge and learned Judicial Magistrate Ist Class, Kaithal respectively.
Notice of motion was issued on 31.05.2012 but the summons issued to respondent either have not been received back served or unserved or the petitioner did not collect dasti notice. Many opportunities were given to the petitioner to serve the respondent by way of dasti process but no efforts have been made so far. On the last date of hearing i.e. 14.08.2015, last and final opportunity was granted to the petitioner to serve the respondent but today, neither counsel for the petitioner is present nor any efforts have been made by him to collect dasti notice.
