Main case Instant petition has been filed under Section 482 Cr.PC for quashing of the order dated 17.11.2022 vide which the bail bonds and surety bonds of the petitioner have been forfeited on account of non-appearance on 17.11.2022, in FIR No.250 dated 01.12.2020 under Sections 379-B, 34 IPC registered at Police Station Division No.7, Ludhiana. Learned counsel for the petitioner submits that the petitioner was on bail in the FIR in question and had been regularly appearing before the trial Court, however, on 17.11.2022 he could not appear before the Court concerned as he was running high fever. Learned counsel further submits that the petitioner is ready to appear and join proceedings before the trial Court.

On the asking of the court, Mr. Ramdeep Partap Singh, Sr. DAG, Punjab, accepts notice on behalf of the State. In view of the submissions made above, the petition is disposed of with direction to the petitioner to appear and surrender before the trial Court on or before 23.03.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioner fails to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to him.
