This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 84 dated 04.05.2015 under Section 420 IPC at Police Station Pataran district Patiala. Learned State counsel submits that departmental action is pending against the police official who allowed the petitioner to join investigation without there being any order to this effect. In view of the fact that departmental authorities are seized of the matter, no further order needs to be passed in this regard. Learned State counsel (on instructions from ASI Tehal Singh, who is present in court) submits that pursuant to order dated October 08, 2015, petitioner has joined the investigation and is no longer required for custodial interrogation. In view of the above, order dated October 08, 2015 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
