Learned counsel for the petitioner has submitted that in light of the status report filed by the respondent, it transpired that prosecuting agency is in process of filing a cancellation report in the FIR lodged by the petitioner but the petitioner is not ready to compromise the matter as there was the threat perception.

Accordingly, at the outset, learned counsel for the petitioner submits that the cancellation report shall be protested and is not acceptable to them, whatsoever it may be.

In light of the above, the present petition stands disposed of with a direction to respondents No. 3 & 4 to assess the threat perception to the petitioner.

However, this order shall not be taken as an alibi or a defence or an incidence that the petitioner was threatened and shall have no bearing on the trial proceedings in the FIR case.

This order is also without prejudiced to all the rights and defence available to the petitioner to not accept the cancellation report before the trial Court.
