**** Manjari Nehru Kaul, J.(Oral) CM-7434-C-2022 This is an application under Order 23 Rule 3 CPC r/w 151 CPC for deciding the said appeal in view of compromise dated 12.03.2022. After hearing learned counsel for the applicant and perusing the paper book, application is allowed and the main appeal along with CM No.2788-C-2022 is taken on board for hearing today itself. CM-2788-C-2022 This is an application under Order 22 Rule 4 r/w Section 151 CPC for impleading the applicants as legal heirs of Jagjit Singh (deceased) who was earlier impleaded as LR of respondent Harpal Kaur. Learned counsel for the appellants does not have any objection for impleading the applicants as legal heirs of the respondent. After hearing learned counsel for the parties and perusing the paper book, application is allowed and the name of persons mentioned in SONIA BURA 2022.12.14 10:38 I attest to the accuracy and integrity of this document

RSA-1495-1994 (O&M) -2para 4 of the application are directed to be impleaded as legal heirs of the deceased respondent.

Amended memo of parties filed along with the application is taken on record subject to all just exceptions. Main case Learned counsel for the appellant, at the outset, submits that during the pendency of instant appeal, parties have amicably resolved their dispute and arrived at a compromise dated 12.03.2022 (Annexure A-1). He thus, prays that keeping in view the compromise arrived at between the parties, the instant appeal may be disposed of as per the terms and conditions of the compromise.

Learned counsel for the respondents does not dispute the submissions made by counsel opposite with respect to the parties having settled their dispute amongst themselves vide compromise deed dated 12.03.2022 (Annexure A-1). He also does not oppose the prayer made for disposing of the instant appeal in terms of the aforesaid compromise deed. Accordingly, the present appeal stands disposed of in terms of compromise deed dated 12.03.2022. However, it is made clear that the parties shall remain bound by the terms and conditions of the compromise deed (Annexure A-1).

Since main appeal stands disposed of, all pending applications also stand disposed of.
