H. S. Madaan, J. (Oral) This application for transfer of divorce petition titled 'Ravi vs. Smt. Sonu', pending in the Court of Additional District and Sessions Judge, Family Court, Jind to a Court of competent jurisdiction at Kurukshetra, has been filed by applicant Sonu, aged about 26 years, estranged wife of respondent - Ravi, presently residing separately from her husband at Kurukshetra, due to matrimonial discord between the parties.
According to the version of the applicant, the marriage solemnized between the parties on 11.12.2016 at Narwana, District Jind, ran into rough weather, though the couple was blessed with a daughter, namely, Ravneet, born on 13.9.2017. On account of
TA No. 227 of 2019 -2harassment and maltreatment meted out to the applicant by the respondent and his family members, she was forced to leave the matrimonial home, alongwith minor child of the parties and she is residing separately from her husband. Her husband has filed a divorce petition against her in order to cause harassment and inconvenience to the applicant. The applicant does not have any source of income and is dependent upon her parents for her financial needs and those of her minor daughter. Under the circumstances, it difficult for the applicant to travel from her parental place to Jind, to attend the dates of hearing in Court there, covering a distance of more than 110 kms on one side. Therefore the application be accepted.
Notice of the application was given to the respondent, who was duly served and had put in appearance through counsel. Subsequently, the counsel stopped appearing for the respondent in this case.
I have heard learned counsel for the applicant, besides going through the record.
Keeping in view the contentions in the application and submissions made by learned counsel for the applicant, I find that ends of justice demand that the application be allowed. Accordingly, the application is accepted. The petition in question pending in the court of Additional District and Sessions Judge, Family Court, Jind, is withdrawn from that Court and transferred to Family Court, Kurukshetra, for disposal in accordance with law. Parties through counsel are directed to appear there on 3.12.2019.
