Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.347 dated 02.08.2017 under Sections 302, 34 IPC and Section 25 of the Arms Act, registered at Police Station Sadar, Rohtak.

Notice of motion.

Mr.Sukhdeep Parmar, DAG, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR has been registered on the basis of statement of Manjeet. As per the allegations, on 01.08.2017 at a bout 8.30 p.m., Manjeet received information that Pardeep @ Deep has been shot VINEET GULATI 2018.08.21 14:15 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-18531 of 2018 -2dead at Jind road.

The present petitioner has been nominated in this case. He had made disclosure statement that he drove the car, which was occupied by coaccused, who fired gun shots on the person of the deceased near drain No.8. The present petitioner has actively participated in the commission of the offence. The case is at preliminary stage as charges have not been framed yet and there is every chance of tampering with the evidence.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I do not find any ground to grant of benefit of regular bail to the petitioner at this stage. Therefore, finding no merit in the present petition, the same is dismissed at this stage.
