(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.37 dated 12.02.2017 under Sections 307, 452, 323, 325, 382, 511, 506, 148 and 149 IPC (Section 201 IPC added later on), registered at Police Station Derabassi, District SAS Nagar.

Petitioner is attributed injury on non-vital part of the body. Investigation qua him has been completed. Trial is in progress. He is incarcerated for more than a year. Main accused-Ghori has been arrested and is already in custody.

Keeping in view, period of his incarceration and the fact that trial may take long time to conclude, petitioner deserves to be enlarged on bail. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, SAS Nagar, Mohali.
