******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 66 dated 29.03.2017 registered for offences punishable under Sections 399, 402, 472 of Indian Penal Code (for short, "IPC") and 25 of the Arms Act, at Police Station City Jagraon, District Ludhiana Rural. Heard.

As per case of prosecution, five accused, namely, Sukhjinder Singh, Sultan Singh, Varinder Pal Singh, Baljit Singh and Gurvinder Singh were apprehended while they were planning to commit dacoity. During investigation, Baljit Singh suffered a statement that they alongwith Gurleen and other persons have snatched the Scorpio car and .12 bore gun from village Daggru. Allegation against the petitioner is that he accompanied Gurleen in snatching .12 bore gun.

Learned counsel for the petitioner submits that only allegation against petitioner relates to snatching of a .12 bore gun, with regard to Jitender Kumar 2017.07.14 16:45 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-17664 of 2017 -2which a separate FIR was registered in which the petitioner was arrested and is on regular bail.

Learned State counsel after taking instructions from ASI Harmesh Kumar submits that the petitioner is on bail in the case pertaining to snatching of .12 bore gun.

As the petitioner is already on regular bail in the case pertaining to snatching of .12 bore gun, which is not subject matter of present FIR; without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, the present petition is allowed. Petitioner-Tejinder Singh @ Teji is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
