**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 50 dated 9.12.2015 registered at Police Station Women, Jhajjar, District Jhajjar under Sections 376-D, 506, 120-B IPC.
This is the second bail application moved by the petitioner. The first application was withdrawn on 22.3.2016. Counsel for the petitioner states that the petitioner is 62 years old and he is in custody since 22.12.2015. The complainant has been examined and she is not supporting the prosecution case. State counsel opposes the petition and states that the co-accused had named the petitioner and he was present standing outside the room where the girl was raped.
The girl had been picked up and taken in a car and raped. The FIR was lodged on the same day. The medical was also on the same day. His mobile phone records show his presence in the area that time.
