(Oral) The matter has been taken up through Videoconferencing on account of outbreak of pandemic COVID-19. Petitioner Mandeep Singh @ Deep has come up in this regular bail application in case FIR No. 197 dated 21.10.2019 under Section 22 of NDPS Act, 195, Police Station Sadar Nabha, District Patiala.

Mr. Jagmohan Ghuman, DAG, Punjab, counsel for the State has contended that the petitioner was apprehended on 21.10.2019 by the police while going on a truck and from his conscious possession 630 tablets of Alprazolam each weighing 150 DALBIR SINGH TIWANA 2020.10.08 14:43 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.

CRM No. M-10092 of 2020 (O&M) -2mg. were got recovered and opposed the grant of bail on the grounds of heinousness of the offence.

Learned counsel for the petitioner contended that the entire quantity falls under the non-commercial quantity and the petitioner has already undergone incarceration for more than 11 months 12 days.

Be so as it may, admittedly, as is conceded fairly by the learned State counsel, the quantity falls under the non-commercial quantity and in the light of the period of incarceration and the fact that the trial is not likely to be concluded in near future, no purpose will be served by retaining the petitioner in jail. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, concerned. The present petition stands disposed off accordingly. The observations made herein above shall have no bearing on the merits of the case as these are purely for the disposal of the present bail application.
