 &' Allegations against the petitioner Kulwant Singh Gill in this 3rd application seeking regular bail in case FIR No.02 dated 23.05.2014 (Annexure P1) registered under Sections 420/467/468/471/120=B IPC and Sections 13(1)(d) and 13(2) of the Prevention of Corruption Act, 1988 pertaining to Police Station Vigilance, UT Chandigarh, are that while being President of the Chandigarh Sector 16 Cooperative House Building Society Limited had along with his Executive Members/co=accused/non=applicants had collected 5.42 crores from the member allottees but failed to deposit RATTAN PAL SINGH 2016.01.12 16:51 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



   the same in accordance with the terms and conditions and subsequently, after the matter was highlighted, had deposited certain amount and thereby as per the allegations has embezzled more than 1.00 crore and on account of his misconduct, the Society has suffered financial loss of 3.50 crores approximately. Heard Mr. Mansur Ali, Advocate representing the petitioner; Mr. J.S. Toor, APP UT Chandigarh on behalf of the respondent and perused the records of the case. The first and second regular bail applications were declined by this Court vide orders dated 01.09.2014 and 10.03.2015 respectively and even the Petition for Special Leave to Appeal (Crl.) preferred by the petitioner stood declined by the Hon'ble Supreme Court of India vide orders dated 17.04.2015. Thus, convincingly no fresh ground could be brought before this Court much less made out. In view of the seriousness of the allegations, the present petition does not call for grant of any relief and thus, the same stands dismissed.
