Petitioner prays for bail pending trial in FIR No.22 dated 09.03.2015, under Sections 324/323/506/148/149/326/307 IPC (Sections 326/ 307 IPC added later on), registered at Police Station Goraya, District Jalandhar City.

Learned counsel for the petitioners contends that complainant in this case is petitioners' step-mother. She has falsely implicated the petitioners as well as their grand-mother i.e., the complainant's mother-in-law. CRM No.M-17661 of 2015 [2] No.1 is attributed with an injury on the left wrist of complainant. Petitioner No.2 - Daljit Kumar is allegedly unarmed though attributed with fist blows etc. It is primarily a dispute regarding property between the parties. Petitioners are in custody since 26.03.2015. No useful purpose would be served by keeping the petitioners incarcerated any longer. Petitioners undertake not to abuse the concession of bail, if granted.

Learned counsel for the State while refuting the abovesaid contentions submits that the petitioners have caused injuries to their stepmother. Other co-accused are at large. There are no allegations on behalf of the State that petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. In view of the above but without commenting or expressing any opinion on the merits of the case, this petition filed by Satwinder Kumar @ Jinda and Daljit Kumar is allowed. Petitioners shall be released on bail pending trial subject to their furnishing requisite bail bonds and surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Jalandhar. Any observations made here-in-above shall not be construed to be a reflection on merits of the case and shall have no bearing on trial. ( LISA GILL ) June 3 , 2015.
