The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.165 dated 10.07.2010 registered for the offences punishable under Sections 148, 452, 323, 427, 506 read with Section 149 of Indian Penal Code, at Police Station Sadar Jalandhar, District Jalandhar. Heard.

Learned counsel for the petitioner submits that petitioner was on bail in this case but he had to go abroad and was declared proclaimed offender. She further submits that co-accused, who faced trial in this case, have since been acquitted. Relying on the order dated 07.04.2017 passed in CRM-M-11838 of 2017 (Sarabjit Singh @ Sabi Vs. State of Punjab), she further submits that petitioner be allowed pre-arrest bail in this case. CRM-M-17717-2017 -2The petitioner was on bail in this case. As per submission of learned counsel for the petitioner, he jumped bail and went abroad without seeking permission of the Court.

Keeping in view the above facts, I do not find it a fit case where the benefit of pre-arrest bail can be extended to the petitioner. The facts of the case cited above are altogether different and are not applicable to the facts of the present case. There is no merit in this petition. Dismissed.
