(Oral) Today, at the very outset, learned senior counsel for the petitioner submits that he may be permitted to withdraw the instant petition at this stage with liberty to apprise the trial Court as regards the true and relevant facts of the case at the stage of consideration regarding framing of charges, as in the present case proper investigation has not been conducted and 3 of the accused, who are specifically named in the FIR, have been declared innocent though there is convincing evidence to establish their involvement.

In view of the aforesaid submission, the petition is dismissed as withdrawn at this state with liberty as prayed for.
