Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in complaint case bearing No. COMA 8758 dated 22.08.2016, under Section 138 of the Negotiable Instruments Act, 1881 (hereinafter referred to as "the Act").

Learned counsel for the petitioner contended that petitioner was summoned as an accused in case under Section 138 of the Act and was admitted to bail. His bail was cancelled because of his non-appearance before the learned trial Court on 12.09.2018 and within a short span, he was declared proclaimed person, whereas the circumstances were beyond his control. More so, petitioner is ready to surrender before the learned trial Court and to face trial.
