RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for issuance of direction to respondent No.3 to submit final report under Section 173 Cr.P.C. in case FIR No.48 dated 06.08.2014 registered under Sections 326, 324, 323, 341, 148 and 149 IPC at Police Station Behrampur. Learned State counsel, on instructions from S.I. Makhan Singh, submits that police has prepared cancellation report in the instant case, which shall shortly be filed in the Court. Therefore, this petition has rendered infructuous. Dismissed as having rendered infructuous.

However, State is directed to submit final report/cancellation report, whatsoever, in the Court within ten days from today positively, failing which Investigating Officer or the erring official shall be taken to task by passing appropriate order against him, including initiation of departmental action and imposition of exemplary costs also and the petitioner shall be entitled to get restored the FIR in question, in case, the report as aforesaid is not filed in the time-bound manner as directed.
