Appellant remains unrepresented. Similar was the situation on the last several dates of hearing. It appears that efforts were made to issue fresh notice to the parties. However, as per report from the Registry, appellant's brother refused to accept notice. Respondent's brother also refused to accept notice and informed that respondent has remarried in Rajasthan after a compromise was arrived at with the appellant. In view of above, it appears that no cause of action survives in this appeal. Same is, thus, dismissed as having been rendered infructuous.
