(Oral) The allegations against petitioner Angrej Singh @ Baba in this regular bail application are that on 8.1.2016, police accosted a Scorpio vehicle in which three persons were travelling who ran away from the spot. Learned counsel for the petitioner contended that the only evidence against the petitioner is the confessional statement of his coaccused Sukhdev Singh @ Sukha and very legality and validity of that evidence is debatable issue and this factual aspect and argument could not be controverted by the learned State counsel. It is further contended by the learned counsel for the petitioner that the petitioner is in custody since 15.2.2016 and the trial is not likely to be concluded in near future.

In view of aforesaid, without going into the merits of the case, this Court is of the opinion that further detention of the petitioner in the Dalbir Singh Tiwana 2016.10.07 18:15 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.

Criminal Misc. No. M-18728 of 2016 -2present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Moga.
