CWP No. 6865 of 1999 Learned counsel for respondents Nos. 2 to 4 refers to para 13 of the plaint dated 17.7.2010 (Annexure P-9), filed by the petitioners, to contend that civil suit was filed by the petitioners claiming that present writ

Civil Writ Petition No. 6865 of 1999 petition has been dismissed as not maintainable. He also refers to judgment dated 31.1.2014 passed by the learned court of competent jurisdiction, whereby suit of the petitioners was decreed. Against the judgment dated 31.1.2014 (Annexure P-10), Smt. Golo Kaur, defendant in the civil suit, has already filed her appeal vide Annexure P-11. He submits that in view of the abovesaid developments having taken place, during the pendency of the present writ petition, it has been rendered infructuous and may be disposed of, as such.

Learned counsel for respondents No. 2 to 4 seems to be correct in making the abovesaid statement. That seems to be the reason that nobody is appearing on behalf of the petitioner.

Sh. N.D. Achint, Advocate, submits that he has filed the present writ petition but the petitioners have taken away the brief from him about six years back and thereafter, they never turned up to pass on appropriate instructions to him.

In view of the above, present writ petition is disposed of, as having been rendered infructuous.
