(Oral) The applicant/wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/465/2023 titled "Amanpreet Singh Oberoi v/s Karamjeet Kaur", filed by the respondent/husband, which is pending in the courts at Ambala and she seeks transfer of the same to the court of competent jurisdiction at SAS Nagar (Mohali).

In pursuance of notice issued, respondent made appearance through counsel and submits that she does not intend to file reply, though she contests the same.

Counsel for the parties heard.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties was solemnized on Sonu 2025.03.05 17:36 I agree to specified portions of this document P&HHC

 TA-298-2024 28.07.2019 and one girl child born from the said wedlock, is presently in the care and custody of the applicant. On account of matrimonial discord, the parties are residing separate. Even, the applicant has filed one complaint, which is pending before the Police Authorities, SAS Nagar (Mohali). Apart from the said complaint, it is submitted that there is no other litigation pending between the parties.

In view of the aforesaid fact situation and also considering the statement made by the counsel for the respondent, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/465/2023 titled "Amanpreet Singh Oberoi v/s Karamjeet Kaur", filed by the respondent/husband, stands transferred from the Family Court Ambala, to the Court of competent jurisdiction at SAS Nagar (Mohali). The requisite record of the aforesaid case be sent by the Family Court Ambala to the District and Sessions Judge, SAS Nagar (Mohali). Learned District and Sessions Judge, SAS Nagar (Mohali), shall assign the said petition to the Family Court, SAS Nagar. Even, the parties are directed to appear before the Family Court, SAS Nagar, within a period of one month from today onwards.
