(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.249 dated 04.10.2024 under Sections 115(2), 118(1), 126(2), 3(5) of Bhartiya Nyaya Sanhita, 2023 (Act No.45 of 2023) (Section 109 BNS added later on), registered at Police Station Kharar, District SAS Nagar Mohali. 2.

Learned counsel for the petitioner inter alia submits that the petitioner is being roped in the FIR on the basis of a vehicle which belongs to his mother and is plying as a taxi and has commercial number plate. At this stage, it is not clear as to whether the petitioner or any other person who was using this taxi are involved in the incident in question. Learned counsel further submits that the petitioner is ready to make himself available for identification parade and cooperate with the investigation agency as and when required. 3.

This Court, vide order dated 27.02.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction Sonia Puri 2025.05.16 18:51 I attest to the accuracy and integrity of this document

Learned State counsel on instructions submits that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 27.02.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
