(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.03 dated 28.01.2025 under Sections 118, 115(2), 127, 351, 190, 191 and 304 BNS (109 BNS added later on), registered at Police Station Kheri Gandain, District Patiala.

Learned counsel for the petitioner contends that the petitioner has been named as an accused in the aforementioned FIR. The allegation against the petitioner is that the petitioner attacked the complainant with gandassa on his internal side of right hand. He further submits that the petitioner is suffering from heart problem. The petitioner is admitted to GMCH-32 due to heart ailment and only 15% to 20% of his heart is working. Moreover, the CCTV footage was also examined in the Court, which shows that the petitioner was not armed at the time of the incident.

CRM-M-11079-2025 -2to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel on instructions from SI-Karambit states that the petitioner has joined the investigation and is not required for custodial interrogation.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 21.03.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
