After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition. He however, prays that the trial Court be directed to grant exemption to the petitioner from personal appearance, he being 70 years old Managing Director of the company, suffering from age related ailments and a resident of Telangana. He is ready to furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which his presence is absolutely necessary.

Dismissed as withdrawn.

In case the petitioner files an application for grant of exemption from personal appearance, the trial Court shall sympathetically consider the same keeping in view the aforesaid facts.
