The present petition has been filed challenging the order passed by the lower Appellate Court whereby the order of conviction passed by the trial Court was set aside and the case was remanded back to Chief Judicial Magistrate concerned for passing speaking order in terms of order dated 23.08.2016. After arguing for considerable time, learned counsel for the petitioner seeks to withdraw the present petition.

In view of above, the prayer so made is allowed. Dismissed as withdrawn.
