RITU BAHRI , J. (Oral) The appellant has been convicted vide judgment dated 10.2.2016 for an offence punishable under Section 302 IPC for committing murder of his wife Sarabjit Kaur.

A perusal of the judgment shows that when the charges were framed and explained to the accused in simple Punjabi language, he has pleaded guilty to the charge framed against him and did not claim trial. Keeping in view the same, he was convicted.

A perusal of the record at page No.13 i.e. charge-sheet dated 10.2.2016 states that on the intervening night of 13/14.11.2015 at about 2:00 GAURAV SOROT 2021.12.15 10:13 I attest to the accuracy and integrity of this document

( 2 ) CRA-D-251-DB-2020 a.m. in the area of village Babowal, the accused had committed the murder of his wife Sarabjit Kuar by intentionally causing her death by giving injuries to her with the help of 'Tawa' (iron plate used for making chapati) and 'Rambi' and thereby committed an offence punishable under Section 302 IPC and within the cognizance of this Court. Statement of Hira Lal at page No.15 of the record shows that after the contents of the charge-sheet have been read over and explained to the accused in Punjabi language, he pleaded guilty and did not claim trial.

As per zimni order dated 10.2.2016, the accused was being represented through Sh. Bishwajeet Uppal, Advocate being free legal aid counsel. Since, he was represented by a counsel at the time of making aforesaid statement, the appeal is hereby dismissed.
