State of Haryana and another
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Ravi Sharma, Advocate for the petitioner.
Mr. R.D.Sharma, DAG, Haryana.
*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari quashing order dated 20.12.2000, passed by respondent No.2, whereby petitioner's claim for promotion to post of Sub Assistant Superintendent has been rejected.
2.
Petition, filed in the year 2001, was admitted for hearing on 07.09.2001 and has been sub judiced ever since.
3.
When taken up for final adjudication after around 21 years, both the learned counsels are unable to assist the Court for lack of instructions. Learned counsel for the petitioner states that despite attempts, his office could not contact the petitioner. In the premise, even issuance of fresh notice to the petitioner on the given address per memo of parties would also be a futility. 4.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 21 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same. MAMTA MALHOTRA 2022.07.18 14:07 I attest to the accuracy and integrity of this order/judgment Chandigarh
CWP-4340-2001 (O&M) -25. Whereas on the other hand learned counsel for the State submits that he too made attempts to get instructions from the office representatives of the respondents, but for lack of any assistance, he is unable to address arguments. 6.
Be that as it may, writ petition is disposed of with liberty to the petitioner to file an appropriate application in case any cause of action still survives.
