(ORAL) Challenge in the present revision is to the order dated 10.01.2024, whereby the learned Family Court, Jalandhar, had directed the petitioner-husband to pay interim maintenance @ `20,000/- per month to the respondent-wife along with one time litigation expenses to the tune of `20,000/-, in an application under Section 125 Cr.P.C., filed by the respondent-wife.

Learned counsel for the petitioner-husband, inter alia, submits that marriage of petitioner with the respondent was solemnized on 12.10.2018. No child was born out of the said wedlock. The parties are residing separately since the year 2019. The petitioner-husband is running a take-away food restaurant at Germany; and refers to Annexure P-4 to submit that petitioner is regularly sending money to the respondent-wife since the year 2018 till 21.10.2021. CRR(F)-361-2024 (O&M) -22024:PHHC:034624 thereafter, the petitioner is facing financial crunch, on account of Pandemic Covid-19 and his mortgage payments have also been increased. In this regard, learned for the petitioner-husband refers to document Annexure P-1 which is the loan details/account of the petitioner.

On a Court query, learned counsel for the petitioner-husband submits that the aforesaid facts/evidence was not brought to the notice of learned Family Court, Jalandhar.

In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the instant revision petition, with liberty to place on record the relevant documents including Annexures P-1 and P-4, before the learned Family Court, Jalandhar. Ordered accordingly.
