This is a petition that has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the respondents to allow the petitioner to change his option to adopt new Assured Career Progression Scheme issued vide circular letter dated 3.11.2006, as due to opting of old ACP Scheme, he is suffering financial loss and persons junior to him are getting higher salary. In this regard, a legal notice dated 11.10.2021 (Annexure P-9) has been given by the petitioner to the respondents but till date no decision has been taken thereon.

Without commenting on merits of the case, I dispose of the instant petition by directing the official respondents to take a decision on the legal notice dated 11.10.2021 (Annexure P-9) of the petitioner in accordance with law within a period of two months from the date of receipt of certified copy of this order, failing which the officer responsible for the lapse would be liable to deposit costs of Rs.20,000/- from his personal pocket with the Punjab and Haryana High Court Advocates Welfare Fund.
