**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this petition for the issuance of an appropriate writ in the nature of mandamus directing the respondents to decide his representation and also to release the amount of Rs.10,44,370/- along with interest which has been deducted by way of applying wrong yard stick to assess the amount payable to the petitioner.

Petitioner is a member of the Labour Construction Co-operative Society and has undertaken the work order of rehabilitation of Jamarai distributor system for various RDs which fall under Jandiala Sub Division, Amritsar. According to learned counsel for the petitioner, the petitioner has already completed the work assignment in the

-2month of December 2015 and thereafter, submitted various bills in the year 2015 itself. The bills have also been duly verified and counter signed by the official respondents who inspected the site. No objection whatsoever was raised at any point of time in respect of commodity and manner in which the work was done. The amount was withheld by the official respondents. Petitioner had to file CWP No.24007 of 2016 for the release of payment along with interest. Thereafter, petitioner had filed a contempt petition i.e. COCP No.3018 of 2017 which was decided on 31.05.2018.

During pendency of the contempt petition, the respondents have passed reduction order and the petitioner had to file one more petition i.e. CWP No.30075 of 2018 which was disposed of vide order dated 14.12.2018 with a direction to the petitioner to sort out the issue with the concerned department. Since then, the grievance of the petitioner has not been redressed. Petitioner has also filed representation dated 10.10.2019 and the same has also not been adhered to in accordance with law.

At present, the grievance of the petitioner is that the representation filed by him be ordered to be decided in a time bound manner.

Notice of motion.

-3On the asking of the Court, Mr. C.L. Pawar, Sr. D.A.G., Punjab accepts notice on behalf of the respondents. In view of nature of order which this Court proposes to pass, there is no necessity of calling upon any response from the respondents at this stage, as no order prejudicial to the interest of any party is being passed.
