(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of F.I.R No. 02 dated 16.01.2015 under Sections 498-A/406 IPC, registered at Police Station Mahila Police, District Patiala.

The matter was adjourned time and again so that the matter could be compromised between the parties but the matter has not been settled so far between the parties.

Learned counsel for the complainant has informed the Court that an arrears of Rs.1,25,000/- is still due towards petitioner. Learned State counsel on instruction has informed that the petitioner has joined the investigation but some recovery is to be effected from him.

In view of the totality of the facts and circumstances of the case, order dated 28.05.2015 passed by this Court whereby the ad-interim GAURAV ARORA 2017.01.27 10:02 I attest to the accuracy and integrity of this document Chandigarh

Crl. Misc No. M-17950 of 2015 anticipatory bail was granted to the petitioner is made absolute, subject to the condition that the petitioner shall deposit an F.D of Rs.1 lac before the trial Court in the name of the complainant within a period of one month. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C. The decision with regard to release of the above said amount will be seen by the trial Court at the final stage.

However, the petitioner is at liberty to file fresh bail bonds after presentation of the challan.
