Mr. Deepak Sabharwal, Addl.A.G. Haryana for respondent. *** NIDHI GUPTA, J. (ORAL) Perusal of order sheet shows that previously the present matter was dismissed for non-prosecution vide order dated 29.11.2018; thereafter, on an application for restoration filed by the petitioner, the matter was restored vide order dated 06.03.2019 and the following order was passed: "Prayer in this application filed under Section 482 Cr.PC is for restoration of the main case, which was dismissed for non-prosecution vide order dated 29.11.2018 passed by this Court. Learned counsel for the applicant-petitioner states that on the relevant date, by the time he had appeared before this Court, the case had already been dismissed for non-prosecution. It was for the first time that the counsel could not appear in the case.

For the reasons stated in the application, the same is allowed and the main case is ordered to be restored at its original number. The main case be now listed for hearing on 31.05.2019." Thereafter, vide order dated 07.12.2019, the petitioner was directed to file an affidavit regarding the status of the petitioner-organization, whether it PUSHPINDER SAINI 2024.03.

  is a registered or unregistered body alongwith its constitution as also that the affidavit containing details of the cases filed by the petitioner, with specific reference to filing cases of the present nature. Despite the fact that the matter has been listed thrice thereafter, on 17.12.2019, 17.01.2020 and 22.08.2023, office report shows that the said affidavit has not been filed till date.

Today, none appeared on behalf of the petitioner. Notice was issued on 12.07.2017 only on the question of maintainability of the present petition.
