(ORAL) When this case came up for hearing on 29.5.2015, following order was passed:- "Learned counsel for the petitioner submits that the order dated 5.11.2009 (Annexure P-2) passed by this court in CRM No.31067-M of 2009 was placed by the respondents before the learned trial court only in the year 2014 and thereafter, the petitioner came to know about this order Annexure P-2 passed by this court. This was the reason that the petitioner could not move the present petition earlier during all these more than five and half years. However, learned counsel for the petitioner seeks time to place on record the relevant zimni order passed by the learned trial court, which would show that the respondents placed the above said order dated 5.11.2009 (Annexure P-2) passed by this court, before the learned trial court at a very late stage.

CRM-M-17995 of 2015 On his request, adjourned to 23.7.2015.

On 23.7.2015, some documents were placed on record, however, learned counsel for the petitioner again sought time and it was granted adjourning the case to 13.8.2015, enabling him to place on record all the zimni orders from 5.11.2009 to 5.8.2014 because the petitioner has approached this Court after an inordinate delay of 5 1⁄2 years. On 13.8.2015, written request was made which was accepted adjourning the case for today. Similar is the position today. Today again, a written request has been made which is not at all justified.

It seems that petitioner is not interested in pursuing the present case.

In view of the above, present petition is disposed of, however, liberty is granted to the petitioner to file fresh petition on the same cause of action, but with better particulars and attaching all the relevant documents, as and when necessity arises.
