Prayer in the instant petition filed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 is for grant of anticipatory bail in case FIR No.517 dated 04.12.2014 under Sections 342, 365, 395, 397, 506 of the IPC and Section 25 of the Arms Act, registered at Police Station Pataudi, District Gurugram.

It is alleged by learned counsel for the petitioner that the petitioner has been named by the co-accused in the aforesaid FIR. Thereafter, he was declared as proclaimed offender in the year 2014. Learned counsel submits that the petitioner is willing and ready to appear, and surrender before the Trial Court. Hence, in the aforementioned facts and circumstances, the petitioner be protected till his appearance before the Trial Court, and directions be given to the Trial Court that his bail application, which he would be filing on his surrender, be decided expeditiously, preferably within a period of three days. On asking of the Court, Ms. Ankita Ahuja, AAG, Haryana, accepts notice on behalf of respondent-State. 5.

Keeping in view the circumstances and the fact that the petitioner has been named by the co-accused and two other co-accused, namely, Billa and Mubarik are still at large, the petitioner deserves to be granted the desired relief. However, the petitioner is directed to appear and surrender before the trial Court within a week from today and move an application for grant of bail which shall be decided by the learned trial Court within a period of three days from its filing. 6.

It is made clear that in case, the petitioner fails to surrender before the Trial Court within a week from today, this order shall be of no use to him.

The petition stands disposed of accordingly.
