CRM-M-17997-2015 Learned counsel for the informant, after taking instructions from Manjit Singh (one of the informants) states at bar that all the 42 persons, including 11 aggrieved persons of the case in hand, have sorted out their dispute and effected a compromise with the petitioners and their co-accused, therefore, the aggrieved person(s) have no objection if the bail is granted to the petitioners. Learned counsel for the petitioners points out that major portion of the amount charged by the petitioners and their coaccused has been returned to the aggrieved person(s) and the remaining amount shall be paid within three months of their (petitioners) release from the jail. He further points out that all the offences for which the petitioners have been booked are triable by learned Judicial Magistrate Ist Class and after completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has been presented. The petitioners are behind the bars from 01.03.2013.
Learned counsel for the State has fairly admitted that the petitioners are behind the bars from 01.03.2013 and all the offences for which the petitioners have been booked are triable by learned Judicial Magistrate Ist Class.
In view of the above, the present petition is allowed. Petitioners, Manoj Shukla @ Manti @ Arjan Singh s/o Harbans Singh @ Lal Bahadur, r/o village Ageta, PO Gopalpura, District Ajamgharh UP and Surinder Batho alias Jit Sharma s/o Babu Lal Batho alias Parkash Sharma, r/o 103-A, Wing Vesnary Apartment, Hanuman Nagar, Kalyan East Thane, Mumbai, presently both are confined in Central Jail No.3, Tihar, New Delhi, are ordered to be released on bail during pendency of the present case subject to their furnishing bail bonds to the satisfaction of learned trial court, provided they are not in custody in any other case. It is made clear that the undertaking before this Court on behalf of the petitioners that the remaining amount of the

aggrieved person(s) shall be paid to them within three months of their release from the jail, if not complied with, the aggrieved person(s) or the Investigating Officer shall be free to move an application for withdrawal of the present concession granted to the petitioners.
