Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.125 dated 30.04.2015 under Sections 148, 149, 302, 307, 452, 506 IPC and Section 25 of the Arms Act, registered at Police Station Matlauda, Panipat, District Panipat. Notice of motion.
Mr.B.S.Virk, Deputy Advocate General, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is in custody since 15.10.2015. The main accused in this FIR has already been acquitted as the complainant and other witnesses have turned hostile as stated by Vineet Gulati 2017.05.26 17:03 I attest to the accuracy and authenticity of this document Chandigarh learned State counsel. The challan against the present petitioner has been
CRM No.M-18055 of 2017 -2filed later on as he was earlier declared proclaimed offender. Keeping in view the facts and circumstances of the present case and in view of the fact that trial of the case will take long time, I find merit in the present petition and the same is allowed. The petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
