The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport.

The petitioner was issued passport on 16.11.2001 which expired on 15.11.2011. Two FIRs i.e. No. 164 dated 14.05.2006, under Sections 326, 34 of IPC at Police Station Jagraon and No. 81 of 25.04.2018, under Sections 420, 494, 506, 120-B of IPC at Police Station Jodhan, came to be registered against the petitioner. FIR No. 164 dated 14.05.2006 stands quashed by this Court vide order dated 07.04.2022 (Annexure P-4). Police after completing investigation filed cancellation report in FIR No. 81 dated 25.04.2018. The trial court has directed the police to make further investigation. The matter is pending before police. He applied for re-issuance of passport on 24.06.2022. Mr. Indesh Goel submits that file of the petitioner has already been closed and petitioner is at liberty to file a fresh application which would be adjudicated, in accordance with law. 6.

Faced with this, counsel for the petitioner seeks permission to withdraw the instant petition with liberty to file a fresh application. 7.
