Heard through video conferencing.

Learned counsel for the petitioners would contend that some residents of Village Shahpur, Tehsil Bhawanigarh, District Sangrur had given an application dated 22.02.2016 (Annexure P-1) to the Gram Panchayat, Village Shahpur seeking to build a Temple of Guru Ravidas and asked for permission to be allotted 11⁄2 bighas of land for the construction of the said Temple/Gurudwara. Thereafter, a Resolution dated 09.06.2016 passed by the Gram Panchayat, Shahpur was reduced into writing whereby it was resolved that with the consent of the whole village 11⁄2 bighas of land be given to Ravidas Sikh Community out of the Shamlat land. The petitioners and the other co-villagers started building a Temple/Gurudwara on 27.02.2021 on the occasion of Guru Ravidas Jayanti.

However, certain antisocial elements wanted to disturb the peace of the village as they do not want this Temple/Gurudwara to come up at the said site. The learned counsel would further contend that in this regard the petitioners as well as the other co-villagers approached the Senior Superintendent of Police, Sangrur and also gave a representation dated 28.02.2021 (Annexure P-5), PARKASH CHAND 2021.03.

CWP No.7165 of 2021 -2however, no action has been taken on the same. The learned counsel would further contend that at this stage the petitioners would be satisfied if a direction is given to the Senior Superintendent of Police, Sangrur (respondent No.4) to take a time-bound decision on the representation dated 28.02.2021 (Annexure P-5).

Notice of motion.

On the asking of the Court, Ms. Sunint Kaur, AAG, Punjab has joined the session through video conferencing and accepts notice on behalf of respondent Nos.1 to 5. In view of the fact that the matter is not being decided on merits, the service on respondent Nos.6 to 9 is dispensed with. In view of the limited prayer made by the learned counsel for the petitioners, without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No.4 to take a decision on the representation dated 28.02.2021 (Annexure P-5), in accordance with law, expeditiously and in any case within a period of 15 days from the date of receipt of a certified copy of this order. Disposed off accordingly.
