The petition is for setting aside the order dated 24.07.2019 passed by the Family Court granting interim maintenance of ` 2,000 per month to respondent No.2-minor child, apart from litigation expenses of ` 1,100.

Learned counsel for the petitioner contends that the petitioner is totally blind. He is surviving only on monthly pension of ` 750 given to the blinds, and staying in a shelter provided by the State. Certificate of his total blindness has been placed on record as Annexure P-1. She further submits that the due to inadvertence, the said certificate and other relevant documents could not be placed on record before the Family Court at the time of passing of the impugned order dated 24.07.2019. Resultantly, the Court held the petitioner to be able-bodied and blind to some extent, which is factually incorrect. In these facts and circumstances, and without considering merits of the case or veracity of the documents attached, the prayer is accepted and the petitioner is allowed to place on record relevant facts about his being totally blind and not earning anything before the Family Court, to seek modification of the impugned order. In case any such application is filed, the same shall be decided by the Court on its own merits, considering the stage of proceedings.
Disposed of accordingly.
