The petitioner seeks the concession of regular bail in a case, which was registered on the basis of secret information to the effect that the petitioner along with others had gathered at an old brick kiln to plan dacoity. The petitioner is not named in the secret information. He was also not arrested from the spot. He was involved in the case on the basis of disclosure statement of the co-accused. He has been in custody for the last 1 1⁄2 years. In said circumstances he can be granted the concession of bail as his co-accused has been granted the similar relief. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court/ Duty Magistrate.
