(ORAL) Petitioner seeks pre-arrest bail in complaint case No. 1557 dated 5.9.2013 under Section 138 of Negotiable Instrument Act, pending in the Court of Judicial Magistrate 1st Class, Patiala. Learned counsel for the petitioner submits that petitioner absented from appearing in the court for the reasons beyond his control. He did not absent intentionally. He further submits that petitioner is ready to surrender before the learned trial court within a period of one week from today and the learned trial court may be directed to consider his bail application sympathetically. Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is disposed of with a direction to the petitioner to surrender before the learned trial court within a period of one week from today. Criminal Misc. No. M-18044 of 2015(O&M) doing so, learned trial court shall consider the bail application of the petitioner on the basis of obtaining circumstances brought to the notice of the learned trial court at the instance of the petitioner. Learned trial court shall decide the bail application of the petitioner at an early date, by passing an appropriate order, strictly in accordance with law.
