This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.53 dated 6.2.2016 registered for the offences under Sections 148, 149, 323, 324, 325, 326, 307 and 506 IPC at Police Station Gharaunda, District Karnal.

Notice of motion to Advocate General, Haryana. Mr. Vikramjit Singh, learned Additional Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioners as well as learned Additional Advocate General, Haryana appearing for the HARPAL SINGH PARMAR 2016.07.13 17:20 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-19024 of 2016 [2] respondent-State and have gone through the record. As per the allegations of the prosecution, Dilshad alias Sadhu and Malkha-petitioners are stated to be armed with Lathi each and have caused injuries to Anwar. The present petitioners are not the main accused. Further more, in the present case the occurrence took place on 2.1.2016 and the FIR was registered on 06.2.2016 against so many persons. The petitioners are in judicial custody since 13.2.2016. The trial of the case will take long time. No useful purpose will be served by keeping the petitioners in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
