**** RITU BAHRI , J. (Oral) Prayer in this petition is for quashing of FIR No. 110 dated 24.08.2012, registered at Police Station Sector 14, Panchkula, who have been booked for having committed the offence punishable under Section 406/498-A/506/323.
Petitioners are father in law and brother in law of the complainant and initially they were found innocent by the investigating agency. The present petition was filed way back in the year 2014 and till today, as informed by the learned State counsel on instructions from ASI Mukesh Kumar out of 16 witnesses, only 03 have been examined till date. The allegations against him are general in nature. Crl. Misc. No. M-18133 of 2014 -2appearance of petitioners are exempted before the trial Court, subject to the following conditions:- (i) petitioners shall be represented through counsel; (ii) shall not delay/stall the trial proceedings; (iii) shall not dispute their identity as an accused: (iv) shall have no objection if the prosecution evidence is recorded in their absence but in the presence of their counsel; (v) shall appear before the trial Court as and when required by the trial Court; and (vi) any other condition which the learned trial Court may impose.
