******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 49 dated 18.03.2017 registered for offences punishable under Sections 420 and 120-B of Indian Penal Code (for short 'IPC'), at Police Station Talwandi Sabo, District Bathinda.
Heard.
Learned State counsel submits that as per enquiry conducted by Superintendent of Police, City Bathinda, the petitioner has formed a gang and cheated people with the promise that they will supply them horses and mares. In this manner, they have cheated various persons to the tune of `35 lacs. Even the petitioner has received `5 lacs from Labh Singh with the promise to supply him horses but neither returned the money nor horses were supplied to Labh Singh.
Learned counsel for the petitioner submits that no payment was received by the petitioner. In fact, the payment was made to owner of Jitender Kumar 2017.06.02 10:06 I attest to the accuracy and integrity of this document CHANDIGARH
CRM-M-18140 of 2017 -2horses. The case is not based on any receipt issued by the petitioner. The present case is based on oral testimonies, which are subject to scrutiny by the police during investigation. Keeping in view above facts, this petition is allowed and the petitioner is directed to surrender before the police and join investigation within a week. In the event of his arrest being required, he shall be released on anticipatory bail, on his furnishing bonds to the satisfaction of Arresting Officer subject to following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court.
(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
