Counsel for the petitioner has submitted that the petitioner has been falsely implicated in the case on the basis of fabricated evidence.
State counsel informs that out of 24 witnesses only 6 formal witnesses remain to be examined. Next date of hearing before the trial Court is 11.3.2016.
In view of stage of the trial, it will not be feasible for this Court to ignore the evidence already led and appreciate the same to determine, prima facie, the culpability of the petitioner. I deem it appropriate to avoid the said exercise lest it should prejudice the right of the petitioner or the Investigating Agency at the time of final trial.

CRM-M-1906-2016 (O&M) Petition is dismissed. However, it is observed that in case the entire prosecution evidence is not concluded within a period of two months after the next date of hearing fixed before the trial Court, it will be open to the petitioner to approach this Court for grant of regular bail.
Nothing mentioned in this order will prejudice the right of the petitioner to seek any benefit on the basis of appreciation of evidence at the time of final decision of the case. (M.M.S. BEDI) February 18, 2016.
