Challenge made in the present petition was to the order dated 02.08.2002, Annexure P-13, whereby the seniority of the petitioner was refixed below Chhote Lal, Clerk. The preliminary submissions on behalf of the respondents is based on inordinate delay and latches on the part of the petitioner as he had accepted the terms and conditions of transfer in the year 1962; the fixation of seniority w.e.f. 14.05.1963 and also gave undertaking dated 13.05.1963, against which he never raised any grievance and subsequently superannuated on 31.05.1998. He filed his first representation in the year 1988, after fixation of seniority. Keeping in view the prayer made in the present petition, filed in 2002, it due to efflux of time might not be surviving.

Disposed of, reserving the petitioner with a liberty to get it revived, in case need arises.
