Mr. Rajbirinder S. Chahal, Addl. A.G., Punjab. **** ANITA CHAUDHRY, J (ORAL) The petitioner is seeking regular bail in FIR No. 176 dated 15.6.2017 registered at Police Station Samrala, District Ludhiana under Sections 306 IPC.

Counsel for the petitioner contends that the petitioner is in custody since June 2017 and charge has been filed and the case is fixed for framing of charge. He also states that this was the second marriage for both the petitioner and the deceased and they had been married for over 10 years and as per the allegations in the FIR, the petitioner suspected his wife of having illicit relations.

State counsel informs that a note in the diary was left which was sent to the FSL but the report is not conclusive and they have asked for some more material for comparison.

During the course of submissions it was also revealed that the petitioner has a son who is 20 years old from the first marriage and the Gurpreet Singh Bhatia 2018.01.23 16:56 I attest to the accuracy and authenticity of this document Chandigarh

Crl. Misc. No. M-1912 of 2018 -2allegations in the FIR have a reference to the relationship with the son of the petitioner.

The investigation is over. Challan has been presented under Section 306 IPC. The trial will take time. It will have to be examined by the trial Court whether the ingredients of Section 107 IPC have been fulfilled. Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
