******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 196 dated 29.11.2012 registered for offences punishable under Sections 279, 304-A and 427 of Indian Penal Code (for short 'IPC') , at Police Station Kurali.

Heard.

Learned counsel for the petitioner submits that the petitioner had noted the wrong date before the trial Court as 29.08.2016 instead of 09.08.2016, as such, could not appear on 09.08.2016 and his non-bailable warrants were issued. Now he has surrendered before the trial Court on 27.01.2017 and was allowed interim bail under order dated 23.01.2017 passed by this Court.

As the petitioner has surrendered before the trial Court, this petition is allowed and order dated 23.01.2017 is made absolute on his furnishing an undertaking that he will keep on appearing before the trial Court on each and every date and will abide by the conditions as envisaged under Section 437 Cr.P.C.
