(Oral) The plaintiff-Revisionist is aggrieved by order dated 29.1.2019, passed by the trial Court, allowing an application under Order 1 Rule 10 CPC filed by the applicant - SDO Construction, DHBVNL. Applicant had contended that he is a necessary party and plaintiffs had intentionally impleaded SDO Construction, HVPNL, in his place. Though the application was resisted by the plaintiffs, but the trial Court arrived at the conclusion that applicant is a necessary and proper party without whom the suit cannot be decided properly and thereby allowed application, leaving the plaintiffs aggrieved, and one of the plaintiffs namely, Nathu Ram has filed the present revision BANITA CHUGH 2019.07.10 16:58 I am the author of this document
CR No. 1604 of 2019 -2petition. I have heard learned counsel for the Revisionist, besides going through the record.
The order under revision is detailed one, giving reasons for arriving at the conclusion. There is no illegality or infirmity therein much less apparent on the face of it. The order can certainly be not termed to be perverse or in violation of settled legal principals. There is no reason to interfere in the same by exercising the revisional jurisdiction by this Court.
