In the High Court of Punjab and Haryana at Chandigarh ......

Criminal Misc. No.M-1920 of 2016 .....

Date of decision:19.1.2016 Jang Bahadur .....Petitioner v.

State of Punjab and others .....Respondents ....

Present:

Mr. Anupam Bhanot, Advocate for the petitioner. .....

Inderjit Singh, J.

This petition has been filed under Section 482 Cr.P.C. praying for issuance of directions to respondents No.2 and 3 to protect life and liberty of the petitioner and his family members and further not to harass him and any of his family members at the behest of private respondent or his associate. It has further been prayed to direct respondents No.2 and 3 not to register any false case against the petitioner at the behest of private respondent.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that as per Annexure-P.1, the petitioner earlier also filed Criminal Misc. No.M-25269 of 2015 under Section 482 Cr.P.C. against State of Punjab and others before this Court for issuance of directions to respondents No.2 and 3 to protect the life and liberty of the petitioner and his family members at the hands of respondent No.4. This Court vide order dated 3.8.2015 disposed of that petition with direction to HARPAL SINGH PARMAR 2016.01.27 11:39 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-1920 of 2016 [2] respondent No.2-Senior Superintendent of Police, Amritsar Rural to enquire into the allegations unfolded by the petitioner in his representation dated 22.3.2015 and in case any substance is found therein, to take appropriate action in accordance with law within a period of three months from the date of receipt of certified copy of that order.

After passing of the order dated 3.8.2015, the petitioner has also filed only one representation dated 4.11.2015 (Annexure-P.2) to Senior Superintendent of Police, Rural District Amritsar. I have gone through this representation. Nothing has been mentioned in this representation regarding any threat to the life and liberty of the petitioner as well as his family members. It has simply been written that the statement is totally wrong/tampered which is with the Police and he had never given such a statement to the Police and to his utter surprise, the Police is trying to safeguard the accused-Dalbir Singh. It is stated that he has not been able to get justice since last eight months. He has written that kindly forward this report to higher authorities for justice and register case against the accused. A detailed perusal of the representation Annexure-P.2 no where shows that after the passing of order dated 3.8.2015 by this Court, any threat was given to the petitioner or his family members at the behest of the private respondent etc.

Therefore, finding this petition without any basis, the same is dismissed.
